What is Form I-765?

Form I-765, Application for Employment Authorization, is the form F-1 students must file with USCIS to request an Employment Authorization Document (EAD). The EAD card is your physical proof of work authorization and is required before you can begin working on OPT.

Every F-1 student applying for Optional Practical Training must submit Form I-765. This applies to pre-completion OPT, post-completion OPT, and STEM OPT extensions. Without an approved EAD, you cannot legally work in the United States, even if your DSO has recommended you for OPT.

Your DSO recommends you for OPT, but only USCIS can grant work authorization by approving your I-765 application and issuing your EAD card.

When to Apply

Timing is critical for OPT applications. Filing too early or too late will result in a denial.

Post-Completion OPT Filing Window

  • Earliest: 90 days before your program end date
  • Latest: 60 days after your program end date
  • Requested start date: Must be within 60 days after program end date

Critical Deadline

The 60-day deadline is absolute. If USCIS receives your application even one day late, it will be denied. Do not wait until the last minute. File as early as possible after receiving your OPT-endorsed I-20 from your DSO.

I-765 Filing Fee

The I-765 filing fee is set by USCIS and changes periodically. Check USCIS.gov for the current amount before you prepare your payment.

You can pay by check, money order, or credit card (for online filing). Checks and money orders must be payable to the U.S. Department of Homeland Security.

The same filing fee applies whether you are filing for initial OPT or a STEM OPT extension. Premium processing requires a separate fee on top of the standard filing fee.

What does "Case Was Being Actively Reviewed" mean?

This status appears when an officer has your case open for review. It does not indicate a problem with your application. It typically precedes an approval or an RFE notice, and is a normal part of adjudication.

How to Complete Form I-765

The most commonly misunderstood field on Form I-765 is Part 2, Item 27: the eligibility category. Selecting the wrong category will cause your application to be rejected.

Choosing Your Eligibility Category

  • (c)(3)(B): Post-completion OPT. Use this category if you have completed your program and are applying to work after graduation.
  • (c)(3)(C): Pre-completion OPT and STEM OPT extension. Use this category if you are still enrolled and working part-time, or if you are extending post-completion OPT with a STEM OPT application.

The most common error is filing a STEM OPT extension under (c)(3)(B) instead of (c)(3)(C). Using the wrong category results in a rejection. Your DSO can confirm which category applies before you submit.

For the requested start date, enter the date you want your work authorization to begin. This date cannot be more than 60 days after your program end date for post-completion OPT. Your name must match exactly how it appears on your I-20.

How to Apply

The I-765 application process involves several steps. Follow each step carefully to avoid delays or denials.

Step 1: Get Your OPT-Endorsed I-20

Before you can file Form I-765, your DSO must recommend you for OPT in SEVIS and issue you an updated I-20 with the OPT recommendation on page 2.

  • Contact your international student office early (2-3 months before your program end date).
  • Complete any required OPT workshops or application forms your school requires.

Step 2: Prepare Required Documents

Gather all supporting documents before you file. Missing documents are a common cause of delays and denials.

Required Documents

  • Form I-20 with OPT recommendation from your DSO (most recently issued)
  • Copy of passport biographical page
  • Copy of F-1 visa stamp (if applicable)
  • Copy of I-94 Arrival/Departure Record
  • Two passport-style photographs (paper filing only; not required for online filing)
  • Copy of current EAD card, front and back (if renewing or extending for STEM OPT)
  • Form I-983 with completed training plan signed by employer and DSO (STEM OPT extension only)

Step 3: File Form I-765 and Pay the Fee

You can file online through your USCIS account or by mail. Online filing is generally faster and allows you to track your case status more easily. The I-765 filing fee is set by USCIS and subject to change.

Check the USCIS website for the current filing fee. Payment can be made by check, money order, or credit card (for online filing).

Step 4: Track Your Application

After USCIS receives your application, you will receive a receipt notice (Form I-797C) with a case number. Use this number to check your case status online at the USCIS website.

What Happens After You File

After USCIS receives your application, several things happen:

    Receipt Notice: USCIS sends Form I-797C confirming they received your application. This usually arrives within 2-4 weeks of filing.

    Processing: USCIS reviews your application. They may request additional evidence (RFE) if something is missing or unclear.

    Approval and EAD Delivery: Once approved, USCIS mails your EAD card to the address on your application. Processing times vary by service center.

Important

You cannot begin working until you have your physical EAD card in hand AND your OPT start date has arrived. Do not start working early, even if your application is approved.

Common Questions

Can I expedite my I-765 processing?

USCIS allows premium processing for certain I-765 categories when available. Check the USCIS website for current eligibility. Expedited processing may also be requested for urgent humanitarian reasons or significant public benefit, but approval is not guaranteed.

What if I need to change my address after filing?

File Form AR-11 online within 10 days of moving. Also update your address with USCIS by calling the Contact Center or submitting an e-request through your online account. Notify your DSO as well.

Can I travel while my I-765 is pending?

Travel while your OPT application is pending is risky. If your application is approved while you are abroad, USCIS cannot deliver your EAD card. Re-entry requires a valid F-1 visa, travel-endorsed I-20, and your receipt notice. Many attorneys recommend avoiding travel during this period.

What if my application is denied?

If denied, USCIS will explain why. Common reasons include filing outside the window, incomplete documents, or ineligibility. You may be able to file a motion to reopen or reconsider. Consult an immigration attorney immediately if your application is denied.
