What Is an EAD Expedite Request?

An EAD expedite request is a formal request submitted to USCIS asking them to move a pending I-765 application ahead of the standard processing queue. Expedite requests are reviewed on a case-by-case basis and are not guaranteed.

The expedite process does not change the outcome of your underlying I-765 application. It only affects how quickly USCIS reviews it.

USCIS Expedite Criteria

USCIS will only grant an expedite if the request meets at least one of four criteria:

  • Severe financial loss to the applicant or employer
  • Urgent humanitarian reasons
  • Compelling US government interest
  • USCIS error

Most OPT situations do not meet these criteria. An impending job start date alone does not qualify as severe financial loss. Documentation of actual financial harm, an employer letter describing the business impact, or a documented medical or humanitarian emergency gives an expedite request the strongest chance of approval.

USCIS denies expedite requests that do not clearly meet one of the stated criteria. Be accurate about your situation. A vague or overstated request rarely succeeds and does not help subsequent requests.

There Is No Fee to Expedite

Submitting an expedite request costs nothing. There is no fee paid to USCIS for expedite requests.

Many students search for the cost to expedite an EAD, which suggests a common belief that a fee exists. It does not. The only pathway to paid faster processing is premium processing via Form I-907, which must be filed at the time of the original I-765 submission.

If someone tells you there is a fee to expedite your EAD directly with USCIS, that is not a legitimate USCIS service.

How to Submit an Expedite Request

USCIS provides two channels for submitting an expedite request:

  • Online: through your myUSCIS account at my.uscis.gov. Navigate to your I-765 case and select the option to request expedited processing.
  • By phone: call the USCIS Contact Center at 1-800-375-5283. Have your receipt number ready.

When submitting, explain clearly which expedite criterion applies to your situation and provide supporting documentation where possible. A request that states only that you need your EAD sooner is unlikely to be approved.

Expedite Request vs. Premium Processing

These are different mechanisms with different timing requirements:

  • Expedite request: submitted after filing, no fee, no guarantee. Reviewed on USCIS criteria.
  • Premium processing (Form I-907): must be filed at the same time as the original I-765, paid fee, 15-business-day processing guarantee. Cannot be added to a pending application.

If your I-765 is already pending, premium processing is no longer available. An expedite request is the only remaining option for faster review.

Premium processing is a stronger option when available because it provides a guarantee. If you expect to need your EAD quickly, request premium processing when you file.

Timely Filers: What Happens If Your EAD Is Late

Students who filed a timely OPT application, at least 90 days before the program end date with a requested start date no later than 60 days after program end, may have continued employment authorization if their EAD has not arrived by the start date they requested.

USCIS rules on delayed EAD employment authorization for timely filers have changed over time. Verify current policy at uscis.gov, and contact your DSO if your EAD is taking longer than expected.

If your OPT start date is approaching and your EAD has not arrived, contact your DSO before taking any action. They can confirm the status of your application and advise on whether you can begin work.
